Terms of Service

The following "Terms of Service" apply to ensure that only the best service is given to Clients. By using these services, you ("The Client") agree to adhere to the Terms and Conditions at all times. Neonsparkle.net ("Us", "We", "Our" "Ours") reserve the right to refuse service to anyone, for any reason, which may or may not be disclosed. Neonsparkle.net also reserves the right to modify these Terms at any time, with or without notice.

Webhosting Terms

Inappropriate Content

Strictly none of the following may be uploaded to Neonsparkle.net webhosting accounts:

Proxies (web or otherwise)
IRC software of any kind
"Warez"/pirated material
Media (including (but not limited to) music, video, images) of any sort for which the Client does not hold the copyright, or licence to use
Pornographic content
Illegal or inappropriate material of any sort*
Any of the following scripts: Greymatter, PHPFanBase, Flinx, Flinx Collective, PHPCurrently, PHPCalendar, PHPQuotes, Wak's Ask&Answer, WakHosting, YaBB and any script(s) based at or formerly based at scripts.inexistent.org, scripts.stormynights.org, luved.org.

Failure to observe the above will result in immediate account termination without notice for which refunds will not be given.

* What is determined "inappropriate" is entirely at the discretion of Neonsparkle.net.

Packages

The hosting "packages" available on the "webhosting" page are provided as a guide only and custom orders can be obtained via communication with Neonsparkle.net. Please note however that prices given by ourselves are final; be it a custom order or one of the "packaged" orders, prices will not be changed through "negotiation" methods including (but not limited to) "haggling" or bribing, nor will they be exchanged for other products and/or services whatever those may be.

Payment

Hosting must be paid for in full before accounts will be created on the server.
Payments are to be made via PayPal. No other form of tender is accepted. Payments can be made in US Dollars (USD) or British Pounds (GBP) only.

Dissatisfaction

Clients have thirty (30) days after their initial sign-up date to request their money back for any reason. After this date, refunds will only be refunded for unused months, if any. A month will count as "used" if the first of that month has passed.

Backups

Neonsparkle.net DOES NOT keep regular backups of Clients' sites or designs. Clients are expected to backup their own data via cPanel or other convenient method. We shall not be held responsible for the loss of any material whatsoever.

Liability

Neonsparkle.net shall not be held responsible for any errors, decrease in site traffic/sales, data loss or any other problems that may arise, whether Clients have used our services or not.
Clients who use our services do so at their own risk. We try our best to ensure that all software is fully tested and up-to-date, however due to the nature of the web industry it cannot be guaranteed that all sites, pages and/or scripts/software will be completely bug free and secure. This should be discussed with Neonsparkle.net should it be a matter of concern. Please also note that we DO NOT accept ANY responsibility for your site being "hacked", be it as a result of your use of our services or otherwise.

Webdesign Terms

Adult sites

We will not, under any circumstances, design any site, layout, code or content for use on an "adult" or any other "inappropriate" site. What constitutes an "adult" or "inappropriate" site is entirely at the discretion of Neonsparkle.net.

Payment

Designs must be paid for in part before work is commenced. Minimum advance payment is one third (33.3%) of the total price. Clients who are not satisfied with work thereafter will not be required to pay anything further.
Payments are to be made via PayPal. No other form of tender is accepted. Payments can be made in US Dollars (USD) or British Pounds (GBP) only.

Dissatisfaction

Clients reserve the right to be dissatisfied with any part of a design offered to them. Should Clients decide they do not wish to proceed with the current project, they need not pay the rest of the price of the design. Anything over one third (33.3%) of the total price (if paid) will be refunded on the condition that no more work is required from Neonsparkle.net, and that any work submitted to Clients by ourselves is not used in any way, shape or form including redistribution or any similar acts thereof. Clients may not use partially finished layouts/layouts which have not been paid for IN FULL under any circumstances.
"Deadlines" outlined by Clients shall be respected in every way possible, however if the designer has not completed work by this deadline, this does not entitle Clients to any sort of refund. A reduced price may be in order and this should be discussed with Neonsparkle.net should this arise.
Refunds and what will or will not be paid, is completely at the designer's discretion, and their word shall be final.

Use of layouts

You may not pass off any layout(s) and/or coding/content designed or written for you by Neonsparkle.net as your own work. If you wish to redistribute the design at any point, you will need written permission from Neonsparkle.net. This may or may not be given at designer's discretion; this decision shall be final. Designs are produced solely for use by the individual(s) who requested them; the copyright remains with Neonsparkle.net.

Backups

Neonsparkle.net will endeavour to keep a copy of your design for sixty (60) days after completion. However, requests for resends of any design will incur a fee.

Failure to observe any of the above Terms and Conditions may result in immediate termination of accounts or design contracts and can lead to legal action.

By hosting with, or requesting a design by Neonsparkle.net you agree to and are bound by these Terms at all times.
